These Terms of Service ("Terms") govern your use of the Vertical Jump Bible 2.0 mobile app (iOS) and verticaljumpbible2.com website (collectively, the "Service") operated by MERIDIAN ALCHEMY LLC. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, do not use the Service.

1. License to Use

MERIDIAN ALCHEMY LLC grants you a limited, non-exclusive, non-transferable license to download and use the Vertical Jump Bible 2.0 app on your iOS device for personal, non-commercial use. You may not:

• Copy, modify, or create derivative works from the app or its content
• Reverse engineer, decompile, or disassemble the app
• Rent, lease, sell, or transfer your license to another person
• Use the app to build competing products or services
• Remove or alter any copyright, trademark, or proprietary notices

This license ends if you violate these Terms. Upon termination, you must delete the app and all copies in your possession.

2. Your Account

To use the Service, you must create an account by providing an email address and password. You are responsible for:

• Maintaining the confidentiality of your password
• Ensuring your account information is accurate and current
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breaches at verticaljumpbible2app@gmail.com

You warrant that you are at least 13 years old and have the legal right to enter this agreement.

3. Acceptable Use

You agree not to use the Service to:

• Transmit illegal content, threats, harassment, or abusive material
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to the Service or other user accounts
• Infringe intellectual property rights of others
• Collect or track personal information about others without consent
• Engage in any conduct that violates applicable laws or regulations

MERIDIAN ALCHEMY LLC may terminate your account immediately if you violate this section.

4. HEALTH, EXERCISE, AND SAFETY DISCLAIMER

IMPORTANT: PLEASE READ CAREFULLY.

The Vertical Jump Bible 2.0 app is a training tool designed to help athletes improve their vertical jump. It is NOT a substitute for professional medical, athletic, or coaching advice.

BEFORE STARTING ANY EXERCISE PROGRAM, ESPECIALLY HIGH-INTENSITY JUMP TRAINING, YOU MUST CONSULT WITH A QUALIFIED PHYSICIAN OR LICENSED HEALTHCARE PROVIDER. Exercise carries inherent risks, including but not limited to muscle strains, ligament injuries, stress fractures, and other serious injuries. You are solely responsible for determining whether any training program is appropriate for your physical condition, fitness level, age, and health status.

The content in this app, including exercise descriptions, training programs, and assessments, is for informational and educational purposes only. It is not medical advice. The app does not diagnose, treat, cure, prevent, or manage any medical condition. If you have or suspect an injury, illness, or any health concern, stop using the app immediately and seek professional medical attention.

MERIDIAN ALCHEMY LLC does not provide personal training, coaching, or medical supervision. The app relies on user-entered data and cannot assess your individual fitness level, injuries, limitations, or medical history in real time. You assume all responsibility for how you interpret, apply, and perform the exercises and programs in the app.

By using this Service, you acknowledge that you understand these risks and assume full responsibility for your safety during exercise. You release MERIDIAN ALCHEMY LLC from any liability for injury, illness, or damages arising from your use of the app or the training programs it contains.

5. Intellectual Property

The Service, including all content, text, graphics, logos, and software, is owned by or licensed to MERIDIAN ALCHEMY LLC and protected by copyright and trademark laws. The training programs and exercise content are based on the Vertical Jump Bible training system by Kelly Baggett.

You retain ownership of any data you enter (fitness logs, goals, assessments). By uploading data to the Service, you grant MERIDIAN ALCHEMY LLC a non-exclusive, worldwide license to use, store, and process your data to provide and improve the Service.

You may not reproduce, distribute, or publicly display any part of the Service without written permission from MERIDIAN ALCHEMY LLC.

6. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KRESS TECHNOLOGIES DISCLAIMS ALL WARRANTIES, INCLUDING:

• Merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, error-free, secure, or accurate
• That defects will be corrected, or that the Service meets your expectations
• That data will not be lost or corrupted

MERIDIAN ALCHEMY LLC makes no warranty that the Service will produce any particular result, improvement in vertical jump performance, or fitness outcome. Results depend on your effort, consistency, genetics, and individual circumstances—factors beyond MERIDIAN ALCHEMY LLC' control.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KRESS TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MERIDIAN ALCHEMY LLC' total liability for any claim arising from or relating to this Service shall not exceed the fees you have paid to MERIDIAN ALCHEMY LLC in the 12 months preceding the claim (or $0 if you have not paid any fees).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you. In such cases, liability shall be limited to the maximum extent permitted by applicable law.

8. Termination

MERIDIAN ALCHEMY LLC may suspend or terminate your account and access to the Service at any time, without notice, if you violate these Terms or for any other reason. Upon termination, your right to use the Service ends immediately.

You may terminate your account and stop using the Service at any time. Termination does not relieve you of any obligations incurred before termination.

Upon account deletion, we will delete your data according to our Privacy Policy, except where legally required to retain records.

9. Governing Law

These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Texas, without regard to conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Texas for resolution of any disputes.

10. Changes to These Terms

MERIDIAN ALCHEMY LLC may modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" at the top and posting the revised Terms in the app or on our website. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MERIDIAN ALCHEMY LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral.
